Terms of Service

These Terms explain the conditions for using Uppic (the "Service") — image hosting, QR code creation and management, image optimization/conversion, and related tools. Please read them in full before using the Service; we have tried to keep them as readable as a legal document allows.

1. Acceptance of these Terms
By accessing or using Uppic, with or without an account, you confirm that you have read, understood, and agree to be bound by these Terms and the policies they reference: the Privacy Policy, Acceptable Use Policy, Cookie Policy, and Copyright Policy.
If you do not agree with any part of these Terms, please stop using the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
- You must be at least 13 years old. If you are under the age of legal majority, you should have parental or guardian consent as required by applicable law.
- You must not have been previously suspended or removed from the Service for violating these Terms.
- You must not use the Service where prohibited by the laws that apply to you.
3. Accounts
Some features work without an account, but core features such as managing hosted images, Dynamic QR codes, and the API require registration.
- Registration information must be true, accurate, and kept up to date.
- You are responsible for keeping your password and authentication factors (such as 2FA) secure. All activity under your account is your responsibility.
- If you discover unauthorized access to your account, notify us immediately via the contact page.
- One person may hold one free account. Creating multiple accounts to circumvent plan quotas or limits violates these Terms.
4. Use of the Service
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service as intended, subject to these Terms and the quotas of your plan.
- Use the Service only through the official web interface or API, for its intended functionality.
- Do not attempt to access systems, data, or other users' accounts without authorization.
- Do not disrupt or degrade the Service, including abnormal request flooding, intrusion attempts, or unauthorized vulnerability testing.
- Do not reverse engineer, copy, or build a derivative service from any part of the system.
5. File hosting and storage
- File size, file count, bandwidth, and retention limits follow the quotas of your plan.
- Files with an expiry date are deleted automatically when they expire and cannot be recovered.
- The Service is designed for hosting and sharing images — it is not a backup system. Always keep your original files.
- We may apply fair-use limits to protect other users, for example unreasonable high-volume CDN usage on the free plan.
6. User content and ownership
Images and content you upload ("User Content") remain yours — Uppic claims no ownership of your work.
To operate the Service, you grant Uppic a non-exclusive, worldwide, royalty-free license limited to what is necessary to provide the Service: storing, processing, resizing, generating thumbnails, converting formats, and serving your files via our servers or CDN according to the privacy settings you choose. This license ends when you delete the content or your account (except for transient cache or backup copies, which are removed on the system's normal cycle).
- You represent that you own or have the right to publish everything you upload.
- You are solely responsible for your content, including any legal consequences.
- Privacy settings (Public / Unlisted / Private) control who can access your content — see the Privacy Policy for details.
7. Prohibited content and conduct
You may not use the Service to store, publish, or distribute:
- Malware, viruses, or harmful code of any kind.
- Deceptive content, phishing, scams, or impersonation of any person or organization.
- Spam, or content used to support spam campaigns.
- Content that infringes copyright, trademarks, or other rights of any party.
- Illegal content, including child sexual abuse material, incitement to violence, or content that violates Thai or other applicable law.
- Other people's personal information published without consent (doxxing).
The following conduct is also prohibited:
- Unreasonable use of the Service as a storage backend for other systems, or abusing our CDN (hotlink abuse).
- Automated or bot uploads outside the official API and its quotas.
- Circumventing rate limits, quotas, or protective measures by any means.
- Creating QR codes or redirect links pointing to dangerous destinations, such as phishing sites, malware, or layered redirects that disguise the destination.
- API abuse, such as sharing API keys publicly or intentionally exceeding quotas.
Uppic reserves the right to block, suspend, remove content, disable links or QR codes, and suspend or terminate accounts that violate these Terms — immediately and without prior notice in severe cases.
8. QR codes and redirects
- Dynamic QR codes use redirect links on our domain. You remain responsible for the destination at all times, including after editing it.
- Destination URLs are checked for safety; we may reject or disable links that are dangerous or violate these Terms.
- Scan statistics are aggregate analytics — see the Privacy Policy for what is collected.
- If your account is suspended or your plan ends, related redirect links may stop working.
9. API
- API keys are secrets tied to your account. Do not publish or share them.
- API calls are subject to rate limits and plan quotas; circumvention violates these Terms.
- We may evolve the API and will make reasonable efforts to announce breaking changes in advance.
- We reserve the right to revoke API keys used abusively or in ways that threaten system stability.
10. Plans and payment
- Plan details, prices, and quotas are shown on the pricing page. Prices may change with advance notice before your next billing cycle.
- Paid plans renew automatically (monthly/yearly) until cancelled.
- Payments are processed by external payment providers; we do not store your card numbers.
- VAT or other applicable taxes follow the law.
Payments in the current development version run on a Mock Provider — real payment terms apply once a real payment provider is enabled.
11. Cancellation and refunds
- You can cancel your plan at any time from Billing in the Dashboard. Cancellation takes effect at the end of the current billing cycle, and you keep your plan benefits until then.
- Fees already paid are generally non-refundable on a pro-rata basis, except where required by law or at our discretion.
- After a downgrade or cancellation, if your usage exceeds the new plan's quota we may limit some features until usage fits the quota — we will notify you before deleting any data.
12. Uppic's intellectual property
The software, design, logos, trademarks, and all components of the Service (except User Content) belong to Uppic or our licensors. Do not copy, modify, or reuse them without written permission.
13. Copyright infringement
We respect intellectual property rights and expect users to do the same. If you believe content on the Service infringes your copyright, please follow the process in our Copyright Policy (/copyright), which covers takedown notices, counter-notices, and our repeat-infringer policy.
14. Privacy
How we collect, use, and protect your personal data is described in the Privacy Policy (/privacy), which forms part of these Terms.
15. Service availability
We aim for maximum stability, but the Service is provided "as is" and "as available", without warranty that it will be uninterrupted, error-free, or fit for your particular purpose. We may improve, change, or discontinue parts of the Service, and will make reasonable efforts to give advance notice of significant impacts.
16. Limitation of liability
To the maximum extent permitted by law, Uppic and its team are not liable for indirect, special, or consequential damages, loss of data, loss of profits, or loss of business opportunity arising from or related to your use of the Service.
Our total aggregate liability for any claim will not exceed the amount you paid us in the 12 months before the event, or THB 1,000, whichever is greater. This limitation does not exclude rights that consumer-protection law does not allow to be waived.
17. Indemnification
You agree to indemnify and hold Uppic harmless from claims, damages, and expenses (including reasonable attorney fees) arising from your content, your use of the Service in violation of these Terms, or your infringement of any third party's rights.
18. Suspension and termination
- You may delete your account at any time from Dashboard settings.
- We may suspend or terminate accounts that violate these Terms, pose risks to the system or other users, or as required by law — with reasons given where reasonably possible unless prohibited by law.
- When an account is terminated, related content is deleted per the retention cycle in the Privacy Policy. Provisions that by nature should survive (such as limitation of liability) survive termination.
19. Changes to these Terms
We may update these Terms from time to time. For material changes we will give at least 14 days' notice by email or in-service announcement before they take effect. Continuing to use the Service after the effective date means you accept the new Terms. The last-updated date is always shown at the top of this page.
20. Governing law
These Terms are governed by and construed under the laws of the Kingdom of Thailand, and disputes fall under the jurisdiction of Thai courts — without depriving you of consumer protections under the laws of your country of residence.
